Frequently Asked Questions

  • Does a Will avoid probate in Oregon?
Actually, no! It is a common belief that having a Will allows an individual to skip the probate process in Oregon. The probate process is HOW many types of property change from one owner to the next, and a Will is a document telling the court WHO gets that property, so they do very different things. Because probate and Wills both deal with separate parts of the planning process, having a Will does not guarantee skipping probate. There are a number of ways to make sure that your estate will avoid probate. An estate planning lawyer can help you create a plan that works for your situation.
